The Employment (Contractual Retirement Ages) Act 2025, signed into law on December 16, 2025, empowers employees to decide whether they want to continue working. They can notify their employer at least three months but less than a year before their scheduled retirement age, giving them more control over their careers. But what happens if an employer says no?

Employers have one month to respond to a request to work beyond a contractual retirement age, and they must provide a written response with their reasons for declining. These reasons must be objective and reasonably justified by a legitimate employer aim. For instance, health and safety concerns or succession planning could be valid objectives. However, there's a twist: some argue that objective justification should be specific to the individual employee. This means that an employer might need to provide a more tailored explanation for each case, considering factors like an employee's fitness and health.

To clarify these points, a code of practice is expected to be published, offering guidance on what constitutes an objective justification. This is crucial, as it will help employers understand their responsibilities and ensure fair treatment. The code of practice is anticipated to be available in the coming months, providing much-needed clarity for both employers and employees.

The new law will come into effect after a commencement order, a decision made by the Minister. While no specific date has been set, it's expected to happen 'later this year.' The government is committed to providing adequate notice, ensuring a smooth transition for all parties involved. As the Minister's spokesperson noted, clear communication is key, and the department will continue working with the Workplace Relations Commission to develop resources that support a fair and consistent implementation of the new law.
